PUBLIC HEARING NOTICE
MENAN PLANNING AND ZONING COMMISSION
NOTICE IS HEREBY GIVEN that the Menan Planning and Zoning Commission will hold a public hearing to consider a recommendation to the Menan City Council regarding the adoption of an ordinance amending the Menan City Code to provide for Accessory Dwelling Units (ADUs) in compliance with Senate Bill 1354 (2026) and Idaho Code Section 67-6541.

Summary of Proposed Ordinance:
The proposed ordinance would:
• Allow one (1) Accessory Dwelling Unit (ADU) per lot in residential zoning districts where single-family dwellings are permitted;
• Define ADUs as self-contained living units with independent cooking, sleeping, and sanitation facilities, limited to no more than two bedrooms;
• Require ADUs to remain in common ownership with the primary dwelling and prohibit separate conveyance;
• Permit ADUs as a by-right (permitted) use subject to clear and objective development standards;
• Establish development standards including:
o Maximum size of 1,000 square feet of living space;
o Maximum building height of 35 feet;
o Compliance with existing setback, lot coverage, and frontage requirements;
o Minimum lot size of one-half (0.50) acre to qualify for an ADU;
o Off-street parking and shared access with the primary dwelling;
• Prohibit owner-occupancy requirements for either the primary dwelling or the ADU;
• Provide for administrative (ministerial) approval of qualifying ADUs without discretionary review or additional public hearing;
• Amend Title 8, Chapter 8 (Land Use Table) to include “Accessory Dwelling Unit” as a permitted use in the Village District and Traditional Residential zones; and
• Include provisions related to general regulations, homeowners associations, repeal of conflicting ordinances, severability, and an effective date no later than July 1, 2026.

All interested persons are invited to appear and be heard. Written comments may be submitted to the City prior to the hearing or presented at the hearing.
A copy of the proposed ordinance is available for public review at the Menan City Offices during regular business hours.
