TITLE 5 PUBLIC UTILITIES AND PROPERTY

CHAPTER 6 LIVESTOCK ON PUBLIC STREETS

SECTION 5-6-1 LIVESTOCK ON PUBLIC STREETS

   
  (A)          Prohibited Conduct: Any person or persons, or corporation permitting their cattle, horses, mules, asses, hogs, or sheep to run at large upon any of the public streets or alleys of or within the corporate limits of the City of Menan, without being under the control, or on charge of some competent person, or persons, sufficient to control the same, shall be subject to the provisions of this chapter, and it shall be the duty of the City Marshal, to take the same up, and impound them in the City Pound and the person, or persons, or corporation owning any of said animals running at large, contrary to the provisions hereof, shall pay a fine of fifty cents ($0.50) for each and every head of cattle, horses, mules or asses; and fifty cents ($0.50) for each and every head of sheep or hogs which fine so collected by said Marshal shall by him be paid to the City Treasurer.  And the owner of any such animals so taken up and impounded shall pay to said Marshal the cost of feeding the same, not to exceed twenty five cents ($0.25) per head for each and every day they may be so impounded.
   
  (B)           Grazing Prohibited: There shall be nothing in this chapter construed to permit of herding or grazing of any cattle, horses, mules, or asses, sheep and hogs upon any of the public streets or alleys within the corporate limits of the City of Menan, whether in charge of any person or persons or otherwise.  And any of said animals so found grazing or being herded upon said streets or alleys, either in charge of any person, or persons, or otherwise shall be subject to the provisions of this chapter.
